How does the passage of California’s Proposition 64 affect MTS’s drug policy, including pre-employment testing?

The passage of Ballot Proposition 64, which legalized the use and possession of marijuana for adults under California law, does not alter MTS’s prohibition against employees using or possessing marijuana. The MTS Drug and Alcohol Policy states in pertinent part, “Regardless of any state laws protecting the medicinal or recreational use of marijuana, federal regulations prohibit its use by safety-sensitive employees and Agency policy forbids its use for all other employees.” MTS is a federally regulated transportation provider. Section 49 of the Code of Federal Regulations parts 40 and 655 require that MTS prevent the use of drugs and misuse of alcohol in the workplace by establishing a compliant policy and testing program. While the federal regulations only apply to employees who are “safety-sensitive”, MTS applies the same prohibitions in the federal regulations to all employees regardless of their job classification. MTS’s zero-tolerance Drug and Alcohol Policy clearly states that termination of employment is the penalty for any violation of the policy, even for a first offense. Candidates who test positive for marijuana during the pre-employment testing process will not be permitted to begin employment with MTS.
